Refund Policy
This Refund Policy explains how professional fees, our replacement guarantee and refund adjustments work for recruitment services provided by BrillBrains Hiring Solutions, a brand of BrillBrains Consultants Pvt. Ltd. ("BB HR"). It should be read together with our Terms & Conditions.
Last updated:1.Nature of Our Fees
BB HR charges employers a Professional Fee only upon a successful placement — that is, when a candidate introduced by us joins the client's organisation. The fee is calculated as a percentage of the candidate's Annual CTC as set out in Schedule 1 of our Terms & Conditions, and is payable within 30 days of the candidate's joining. As our fees are success-based, they are not advance payments or deposits.
2.Candidates
BB HR does not charge candidates any fee for registration, profile creation, interview coordination or placement. As no payment is collected from candidates, no refund is applicable to candidates. If anyone requests payment from you for a job through BrillBrains, do not pay and report it to us immediately.
3.Replacement Comes First
Our standard remedy if a placement does not work out is a free replacement, not a cash refund. Unless otherwise agreed in writing, BB HR provides a 90-day free replacement guarantee from the candidate's date of joining. If the selected candidate leaves or is terminated within this period, we will source one (1) replacement candidate of a similar profile at no extra cost, provided that:
- all sums due by the client have been paid in accordance with our Terms & Conditions; and
- the client has notified BB HR in writing within seven (7) days of the candidate leaving.
Where a candidate's employment is terminated by the client within 90 days, the client shall provide the reasons for termination in writing.
4.When a Refund / Adjustment Applies
A refund arises only in limited circumstances tied to the replacement guarantee:
Failure to provide a replacement
If BB HR is unable to provide the agreed replacement within the stipulated time, the amount paid by the client for that hiring will be deemed to accrue back to the client. This amount is adjusted against outstanding bills/invoices after the expiry of the aforesaid 30-day period. Where there are no outstanding invoices to adjust against, the eligible amount will be refunded to the client.
5.When No Refund Applies
No refund or replacement will be provided in the following cases:
- Performance issues or internal matters at the client's organisation, except where there has been misrepresentation of degree/qualification or a wrong background verification attributable to BB HR.
- A candidate who was already a replacement — no further replacement is provided for a replaced candidate.
- Where the client has not paid all sums due, or did not notify BB HR in writing within seven (7) days of the candidate leaving.
- Where the departure falls outside the 90-day replacement window.
6.How Refunds Are Processed
- Requests must be raised in writing to connect@brillbrainsconsultants.com within the applicable notice periods.
- Eligible amounts are first adjusted against any outstanding invoices; any remaining balance is refunded to the originating bank account.
- Refunds, where due, are processed within 30 days of the eligibility being confirmed.
- Taxes already remitted (e.g. GST) are refunded or adjusted in accordance with applicable law.
